Is a flatmate agreement legally binding in Victoria?
A signed agreement is strong written evidence of what was agreed, and it can operate as a contract between you — but whether tenancy law also applies depends on how your arrangement is set up. Some flatmate setups fall under the Residential Tenancies Act 1997, which overrides anything inconsistent with it. Do I need one if I'm not on the lease?
That's exactly when you need one. Off-lease flatmates have the least formal protection, so the written record of rent, bond, notice and what was agreed is often the only paper trail you'll have if things go wrong.
Does the bond have to be lodged with the RTBA?
If your arrangement is covered by the Residential Tenancies Act, yes — bonds must be lodged with the Residential Tenancies Bond Authority. Many informal flatmate bonds are instead held by the head tenant; if that's yours, insist on a receipt and a written record of the amount and return terms, which is clause 5 of this template.
